The Fair Work Ombudsman has commenced legal proceedings
against a 7-Eleven retail store in Sydney which allegedly underpaid
two migrant employees almost $50,000 and created erroneous records
for the workers. The owner and his company face penalties of
up to $54,000 per breach.
Fair Work Act penalties now up to $54,000
The maximum penalty for each breach of the Fair Work
Act 2009 has risen to $54,000. This
increase has wide effect, as there is a growing trend in adverse
action claims to prosecute all of the people “involved” in any
contravention, in addition to the company. This may include the
human resources manager, line manager, general counsel, or a
director or officer of the company.
