Labour-hire operator penalised more than $100,000
A labour-hire operator in Sydney who hired young Asian workers
because they are “younger, cheaper and faster than locals who are
old and slow” has been penalised more than $100,000. The Fair Work
Ombudsman said the penalties should help to dispel the myth that
overseas workers of any particular nationality can be paid a
‘going-rate’ that is less than what the law requires.
Tackling redundancy one step at a time

Spot checks of businesses in Central Queensland, around
Rockhampton, Yeppoon, Gladstone, Biloela, Emerald and Blackwater,
has found over 50% are not compliant with Australian employment
laws.
Almost $300,000 penalty for restaurant owner-operators and company
The operators of an inner
Sydney restaurant have been penalised
almost $300,000 for underpaying their employees and using false
records. Restaurant owner-operators Joon Hoe
Lee, Julian Lee and Alan Wing-Keung Au have been penalised $36,992,
$35,360 and $35,360 respectively. Their company
Mamak Pty Ltd has been penalised a further $184,960.
The Fair Work Commission does not get small business
Many tax-payer funded organisations have a ‘problem’ with one or
more of their key stakeholders. The ATO, for example, sometimes
clashes with accountants and bookkeepers. The Health Department
occasionally clashes with the Australian Medical Association. And
the Immigration Department is often in dispute with refugee rights
advocates.
Important Changes to Annual Leave
The Fair Work Commission has recently made a number of
very important changes to annual leave
entitlements for Modern Award-covered employees.
Employers should familiarise themselves with these changes
because they may require existing workplace
policies and procedures to be updated.
HR Oversight Costs Over $54,000
A Fair Work Ombudsman investigation has found a business on the
NSW Mid-North Coast failed to pay correct annual leave entitlements
and calculate accurate leave balances for its shift workers for six
years. The Fair Work Ombudsman says the employer
should have had systems in place to monitor and correctly calculate
its employees’ annual leave entitlements.
$196,000 penalty for Café owner-operators
A mother-and-son business team which deliberately exploited
vulnerable overseas workers has been penalised almost $200,000 and
ordered to back-pay former staff tens of thousands of dollars.
