Many employers find themselves in the unenviable position of terminating a difficult employee with the knowledge that he or she will undoubtedly bring an unfair dismissal claim or worst still a general protections claim.

Below are the most common provisions in a Deed of Release:

  • Ex gratia Payment: In exchange for a nominal payment, the employee gives up his or her right to take legal action in relation to their employment (other than claims which cannot be excluded such as workers compensation and superannuation).
  • Statement of Service: The employee is provided with a positive statement of service.
  • Confidential Details: The employee agrees to maintain the confidentiality of the employer’s information and to keep the terms of the settlement confidential.
  • Mutual disparagement: the parties agree not to disparage each other or injure the other’s reputation.
